In the 2013 Session, Utah Legislators Make Changes to Lien Laws

Each year it seems that the Utah Legislature makes changes to the lien laws.  2013 was no different, although the scope of the changes is relatively minor.  Senate Bill 256 changes the name of a “Notice of Retention” filed by design professionals and others performing preconstruction services to a “Notice of Preconstruction Service.”  The bill also clarifies that all preconstruction liens on a project property are on equal footing regardless of when they are recorded or when the Notice of Preconstruction Service was filed with the State Construction Registry.
