Jones Waldo’s Land Use/Entitlements Practice Group handles both the process of obtaining governmental approvals and defending, or challenging, governmental development decisions.
Representation and Counseling
Our group members have a wealth of knowledge and experience in obtaining governmental approvals (zoning, conditional use permits, master plan development approvals, plat approvals and building permits) for all aspects of commercial and residential development. We have negotiated Municipal Development Agreements, Disposition and Development Agreements, Improvement Agreements, and Completion Security Agreements with local governments. We have represented clients before planning commissions, city councils, county commissions, redevelopment agencies, the Army Corps of Engineers, state highway departments and state and federal environmental agencies. We can assist clients in all aspects of the entitlement process, from conceptual plan to certificates of occupancy.
Advocacy
Whether it is the denial of a requested approval or the grant of an objectionable permit, we have championed our clients' causes before Boards of Adjustment, City Council Meetings, Administrative Hearings and Judicial Proceedings. We are experienced in the areas of takings law, zoning and planning, open meetings acts, conflicts of interest legislation, governmental records acts, nuisance law, administrative proceedings and judicial review.
