Jones Waldo Attorney Appointed Special Master in Water Rights Case
SALT LAKE CITY – November 3, 2016 –Jones Waldo is pleased to announce that shareholder Rick L. Knuth has been appointed Special Master in the general adjudication of water rights in the Utah Lake and Jordan River drainage.
As Special Master, Mr. Knuth will conduct evidentiary hearings, oversee discovery, rule on procedural and substantive motions, and will submit reports and recommendations to the District Court for final disposition of water right claims in the general adjudication of all water rights in the subject area, which includes all of Salt Lake County and the urbanized parts of Utah County. The boundaries of the general adjudication extend from northern Sanpete County in the south, to central Davis County in the north, and from the Heber Valley in the east, to the crest of the Oquirrh Mountains on the west.
During the last general session, the Utah State Legislature amended the statute to allow for the appointment of a master in general adjudication cases. Those statutory changes and corresponding funding passed during the general session, were aimed at modernizing and streamlining the general adjudication process. Masters are rarely used and then typically only employed in highly specialized cases. With over 65 applicants, Rick Knuth was honored to accept the position.
