Attorney Michael Patrick O'Brien Wins Utah Court of Appeals Employment Case
Mike O’Brien, representing a national automotive parts and accessories retailer, won a case recently in the Utah Court of Appeals. The case involved an employee asking for reimbursement for clothing purchased that he felt represented a uniform. Mike successfully argued that the employer’s request did not represent a uniform per se and thus the employer was not obligated to reimburse the employee. Here is a link to the decision (red shirt and black pants do not a uniform make): http://www.utcourts.gov/opinions/appopin/juricic042910.pdf.
